PULSE RELEASE AND WAIVER OF LIABILITY

Pulse (hereinafter, the “Event”) is presented by Aurora Healthcare (“Aurora”) and Milwaukee World Festival, Inc. (“MWF”). The date of the Event is September 13, 2025, from 10:00 a.m. until 3:00 p.m. and the Event is held at Henry Maier Festival Park in Milwaukee, Wisconsin. Activities at the Event include yoga, HIIT classes, spin, boxing, self-defense, meditation, and other activities that require physical involvement by the participant (hereinafter,” individually and collectively, the “Activity” or “Activities”). All participants must sign this waiver (the “Waiver”) before participating in the Activities. THE WAIVER RELEASES MWF, THE CITY OF MILWAUKEE, THE BOARD OF HARBOR COMMISSIONERS, AURORA, ALL OTHER MWF VENDORS AND PARTNERS ASSOCIATED OR OTHERWISE INVOLVED WITH THE EVENT, AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS (COLLECTIVELY, THE “REALEASED PARTIES”) FROM POTENTIAL LIABILITY ARISING FROM THE EVENT AND THE ACTIVITIES. If the participant is under the age of 18, a parent or legal guardian must review and agree to the Waiver on their behalf. You (or your parent or legal guardian, as applicable) must review the Waiver in its entirety prior to agreeing to it. 

  1. Waiver and Release: I release, forever discharge, and hold harmless the Released Parties from any and all liability, claims, and demands which arise or may hereafter arise from my participation in the Event and Activities by virtue of the Released Parties’ acts, omissions, and/or negligence. I understand and acknowledge that this Waiver discharges the Released Parties from any liability or claim for negligence that I may have against the Released Parties with respect to bodily injury, personal injury, illness, death, or property damage or theft that may result from the Event and/or Activities.
  2. Insurance: I understand that the Released Parties do not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. I expressly waive any such claim for compensation or liability on the part of the Released Parties beyond what may be offered freely by the Released Parties in the event of injury or medical expenses incurred by me. Notwithstanding the foregoing, I consent to receive medical treatment from the Released Parties which may be deemed advisable in the Released Parties’ sole discretion in the event of injury, accident, and/or illness during participation in the Event or the Activities.
  3. Assumption of Risk: I understand that the Event and Activities may include activities that may be hazardous to me including, but not limited to, strenuous physical exertion, the consumption of certain foods and/or beverages, or bending and stretching. I acknowledge that participating in the Event and Activities comes with risk and expressly assume that risk and release the Released Parties from all liability associated with the same. I further acknowledge that I am responsible for ensuring that I can safely ingest or am not otherwise allergic to any food or beverages provided to me at the Event.
  4. Fitness for the Event. I certify that I have not been advised by a medical professional not to participate in any of the Activities. I certify that I have sufficiently prepared or trained for all Activities that require an advanced level of participation or athletic ability. I agree to inform the instructors of the Activities of any injuries, surgeries, or any physical or mental limitations on their participation in the Activities.
  5. Third Party Claims. I understand that, as an Event participant, I am not an agent of the Released Parties. I further understand that the Released Parties are not agreeing to indemnify, defend, or hold me harmless for any of my acts or omissions, regardless of whether they are intended as part of the Event and/or Activities or I am instructed by the Released Parties to take such acts or omissions. Any liability that may result from my acts or omissions is solely my responsibility and I agree to indemnify and to hold harmless the Released Parties with regard to any claim or expenses (including reasonable attorneys’ fees and other costs) of defending any claim brought by a third party that arises from or out of my acts or omissions.
  6. Photographic Release: I grant and convey to MWF and Aurora all rights, title, and interests in any and all photographs, names, images, videos, or audio recordings of me or my likeness or voice made in connection with the Event and allow MWF and Aurora, and those they designate in their sole discretion, to use the same for editorial, advertising and publicity purposes, at any time.
  7. Personal Information. By registering for the Event, I am hereby agreeing to the Privacy Policy located at https://www.summerfest.com/privacy-policy/.
  8. Choice of Law, Venue, and Jurisdiction: This Waiver shall be governed by and construed according to the laws of the State of Wisconsin. Any litigation relating to this Waiver, the Event, or the Activities must be brought in the state and federal courts having jurisdiction in Milwaukee County, Wisconsin, and I consent to the jurisdiction of such courts.

By agreeing to this Waiver and participating in the Event, I express my understanding and intent to enter into this Waiver willingly and voluntarily.
