LIABILITY WAIVER RELEASE, PERMISSION, AND INDEMNITY AGREEMENT

Waiver:
In consideration of being permitted to participate in any way in any programs or play on any pickleball courts being on the grounds of Henry Maier Festival Park, I, for myself, my heirs or assigns, do hereby release, waive, discharge and covenant not to sue Milwaukee World Festival, Inc.,  MWF, LLC, The Board of Harbor Commissioners and the City of Milwaukee, or any Milwaukee World Festival, Inc. sponsors, its/their directors, officers, employees or agents from liability from any and all claims resulting in personal injuries, accidents or illnesses (including death) and property loss arising from, but not limited to, participation in any event, lesson, league, camp, tournament, organized play or general court usage.

Assumption of Risk:
Participation in any event, lesson, league, camp, tournament, organized play on any court in anyway carries with it certain inherent risks that cannot be eliminated regardless of the precautions that are taken to avoid injuries. The specific risks vary, but include 1) minor injuries such as bruises, sprains and dehydration, 2) major injuries such as eye injuries, joint or back injuries, heat stroke, heart attacks, and concussions, and 3) catastrophic injuries such as paralysis and death, and 4) such as communicable diseases including COVID-19. I have read the previous paragraphs and I know, understand and appreciate these and other risks that are inherent in playing pickleball. I assert that my participation is voluntary and that I knowingly assume all such risks.

Indemnification and Hold Harmless:
I also agree to indemnify and hold Milwaukee World Festival, Inc.,  MWF, LLC, The Board of Harbor Commissioners and the City of Milwaukee, or any Milwaukee World Festival, Inc., sponsors, its/their directors, officers, employees or agents harmless from any and all claims, actions, suits, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my involvement with pickleball at this location.

Use Permission:
I also give Milwaukee World Festival, Inc. and its agents and assignee's permission to use or distribute, without limitation or obligation, my image, name, voice, and words for any purpose connected with Milwaukee World Festival, Inc., including promotional, marketing, training, informational, and archival uses.

In consideration of being permitted to participate in any way in any Milwaukee World Festival Inc. activity hosted by Milwaukee World Festival Inc.’s affiliates including but not limited to Lami Sports or any other entity assisting or using such courts("Event Host"), I, for myself, my heirs or assigns, hereby release, waive, discharge and covenant not to sue such Event Host, any of its pickleball instructors, any other event organizers, directors(s), their officers, employees or agents from liability from any and all claims resulting in personal injuries, death, accidents, illnesses (such as communicable diseases including COVID-19), and property loss arising from, but not limited to, participation in any event, lesson, league, camp, tournament, organized play or general court usage.
